Change of Ownership and Exemption of IMI

(Acquisition of real estate for Own and Permanent Housing)


We are often asked by our Clients about the deadlines to be met and the tasks required by law after the acquisition of goods destined for Own and Permanent Housing. Thus, we decided to compile all the information to facilitate the whole process.


What needs to be done?


1. Change of address on citizen card/residence permit (of the holder and household):

DEADLINE: 15 calendar days from the date of formalization of the purchase and sale


How to change the address?


1.1. By going to the Citizen's Space, the change of address is FREE. If you choose to use a Desk of the Institute of Registers and Notary, the service has a cost of 3,00€. On the day, you must bring the PIN code of your Citizen Card to change the address, sent at the time of the document collection.


1.2. It is possible to make the change online, FREE of charge. To change the precise address: - or the Citizen Card, its PIN code and a card reader, - or the PIN code of your Digital Mobile Key and the phone associated with it


1.3. You can also call 300 003 990, and this service is FREE. The value of the call is that of a call to the fixed network, according to your tariff plan. Available on weekdays from 9:00 am to 6:00 pm). In this case, to change the address you need to have the Digital Mobile Key active and have the app Autenticação.gov installed on an Android device or an iOS device.


1.4. You can go to the SEF (Foreigners and Borders Service) and change the address with the presentation of the certified photocopy of the contract. If there is difficulty in getting an appointment within the period of 15 days, the appointment must be made by e-mail so that you can put in writing that the reason for the same is to communicate a change of address of the new Permanent Own Housing. At the same time and at the same time, you can and must change your tax domicile on the Finance Portal or with a finance office.


2. Change of Ownership and IMI Waiver Application (if applicable):


How to do it?


2.1. After receiving the electronic deposit code, make the request to change ownership of the property. To do so, request from the finance service (in person, via e-counter, or by email) by delivering a simple copy of the purchase and sale contract and its authentication term, and the electronic deposit code sent in the email.


2.1.2. In a continuous act, if the property has been purchased for permanent residence and the new owner meets the IMI exemption requirements (listed in paragraph 3.) he shall make the IMI exemption request through the IMI > Services Finance Portal > IMI > Application for EXEMPTION IMI.



3. Conditions for benefiting from the IMI exemption:


3.1. Notwithstanding what is suggested in 2.1.2, by purchasing a property for permanent residence, the IMI Exemption must operate automatically. The assignment of permanent exemption or temporary exemption is made automatically and recognized every year by the Tax Authority, based on the elements available to it (IRS declaration of the household, for example), and it is not necessary to request it.

Still, it is advisable to do so, as suggested in 2.1.2.


3.1.1. "Temporary" form of IMI exemption (up to three years) - Property asset value up to 125,000.00€ - Exemption period of 3 years. The equity value is found in the Urban Building Booklet;


3.1.2. A "permanent" form of IMI exemption - where the taxpayer and the family living with him/her has a gross annual income of less than 15.295€ (2.3 indexes of social support calculated at 475€), and properties in store have an asset value of less than 66,500€.
